Membership Rules & Regulations
1. Health & Safety (The "Healthy Child" Policy)
Symptom-Free Zone: Children may not enter if they have had a fever (>37.5°C), vomiting, or diarrhea within the last 24–48 hours.
Exclusion Criteria: Entry is prohibited for contagious rashes (e.g., Hand-Foot-Mouth), parasites (Lice, Scabies), or a positive COVID-19 test. If a child was sent home from Kita due to illness, they cannot attend NEST CoWork & Play.
Right to Screen: Staff may perform non-invasive health checks (forehead scans/visual checks) upon arrival or if symptoms develop. We reserve the right to send home kids that are ill or appear to be ill.
Mandatory Pickup: Parents must remove their child from the play area immediately if they become ill during a session.
Smoking Policy: NEST CoWork & Play is a smoke-free environment. Smoking and vaping are strictly prohibited inside and directly in front of the entrance.
2. Measles Vaccination Requirement
In accordance with the German Measles Protection Act (Masernschutzgesetz, § 20 IfSG), proof of complete measles vaccination (two doses) is mandatory for all children aged 12 months and older who wish to use the childcare facilities at NEST CoWork & Play.
Exemption for Infants: Children under 12 months of age who have not yet reached the recommended age for measles vaccination are exempt from this requirement. However, childcare is only available once the child provides valid proof of vaccination. In the meantime, parents can use our designated "Baby Memberships" at 50% off and work from our Babywearing Desks and PlayPen Desks.
Proof of Vaccination: The child's vaccination record (Impfpass) must be physically shown upon the child's first visit.
Registration Confirmation: By completing the registration process, parents/guardians confirm that their child has received, or will receive upon reaching the eligible age, a complete measles vaccination.
Failure to Provide Proof: If valid proof of vaccination cannot be provided for an eligible child, access to the childcare facilities will be denied. The contract will be terminated in such cases, and no refund will be issued for any remaining membership period.
Changes in Vaccination Status: Should a child's vaccination status change or become invalid after registration, parents are obligated to inform NEST CoWork & Play immediately.
3. Facility & Environment Rules
Footwear: Outside shoes are forbidden in play areas. House shoes, slippers, or non-slip socks are mandatory.
Food & Drink: Food is not allowed in play areas, snacks are permitted in the designated snack area. Water bottles must remain at the designated drinking station. Adults and staff must use closed, leak-proof containers (e.g., thermoses) in play areas to prevent burns.
Transportation & Storage: Strollers, bikes, and scooters must be parked in the designated outdoor area. They are not permitted inside. Personal valuables (laptops, etc.) must remain under the member's control at all times.
Damage to Property by Children: Parents and guardians are liable for any damage caused by wilful or grossly negligent destruction of our inventory or equipment. Normal, age-appropriate accidents (such as items being accidentally knocked over or dropped) are explicitly excluded from this policy.
Device & Screen-Time Policy: iPads and digital devices for children are not permitted. In the Nap Room, phone use (scrolling) is forbidden to avoid light disturbance.
Diapers & Clothing: We provide a few extra sets of clothes and diaper supplies for emergencies, but we ask parents to bring a change of clothes as well as diapers and wipes for their child.
4. The Nap Room & Breastfeeding
Safety Standards: Infants under 12 months will be placed on their backs (no heavy blankets or pillows). Cameras above beds must never be moved or covered.
Nap Room Etiquette: Only one parent per child is allowed in the room at a time. Conversation must be kept to a minimum to maintain a calm environment.
Sleep: Parents must put their own children to sleep and respond to them during nap times. No sleep training of any kind is allowed at NEST CoWork & Play.
Breastfeeding: Breastfeeding is allowed anywhere on the premises. If privacy is required, you may use our designated breastfeeding corner inside the Nap Room. Please be mindful of potentially napping children.
5. Integration (Eingewöhnung) & Transitions
Orientation: An optional "Introduction Session" with the primary caregiver (Bezugsperson) is highly recommended.
3-Day Suggestion: We suggest parents stay near the play area for the first 3 days of a new booking before moving to the coworking area.
Crying & Comfort: We practice gentle transitions. If a child is inconsolable, parents will be asked to return to the play area to comfort them.
6. Pedagogical Approach & Boundaries
Bodily Autonomy & Diapering: We follow the Bezugspflege approach. Parents are encouraged to handle diaper changes. Staff will only assist if the child is comfortable and will never force a change if the child says "no."
Physical Boundaries (Under 2.5 Years): Developmental behaviors like mouthing or hitting are monitored. If they occur 3+ times in a session, parent intervention is required.
Behavioral Standards (2.5+ Years): Intentional aggression (hitting, biting, throwing toys) is not permitted.
The Three-Strike Rule: Strike 1: Notification and redirection strategy. Strike 2: Immediate parent intervention; child may be moved to the cafe area. Strike 3: Suspension from play area.
Frequent need for suspension may result in membership termination. See T&C below for more details.
The "Shadowing" Requirement: During difficult behavioral phases, parents may be required to work from the seating area closest to the play area (Krippe-age) or the cafe area (Elementar-age) for immediate intervention.
7. Property & Toys
Outside Toys: To avoid loss or damage, outside toys are not permitted.
Prohibited Electronics: Toys with cameras or recording capabilities are strictly forbidden in play areas. Screens (such as phones and tablets) are not allowed for children in any of our areas including the café.
8. Inclusion, Respect & Zero Tolerance for Discrimination
NEST CoWork & Play is a welcoming space for all people, regardless of origin, nationality, religion, ethnicity, gender, or background. We are a diverse team and community, and we are deeply committed to maintaining an environment where every person feels safe, respected, and valued.
We have a strict zero-tolerance policy toward any form of discrimination, harassment, or hostility – including but not limited to antisemitism, racism, Islamophobia, xenophobia, sexism, and any ideology rooted in hatred or dehumanization of others. This includes verbal comments, written content, symbols, gestures, or any other form of expression.
Political discussion is not part of our community space. We ask all members to keep interactions focused on what brings us together: family, work, and the well-being of our children.
Any member found to express, display, or promote discriminatory views – in any form – will be asked to leave immediately and may have their membership terminated without refund. NEST CoWork & Play reserves the right to make this determination at its sole discretion in order to protect the safety and dignity of all members and staff.
Terms & Conditions
1. Legal Responsibility & Supervision
Duty of Supervision (Aufsichtspflicht): The legal Duty of Supervision remains with the parent/guardian at all times while on the premises. The presence of staff engaging with or caring for children does not transfer this legal responsibility away from the parent.
On-Premises Requirement: Parents/Guardians must remain inside the building at all times while the child is checked into NEST CoWork & Play. Leaving the premises for any reason without checking your child out is strictly prohibited. The first failure to comply results in a written warning; the second is grounds for immediate membership termination.
Allergies & Health: Parents are legally required to disclose any allergies or medical conditions upon registration or immediately upon diagnosis. Failure to do so waives the provider's liability regarding related incidents.
2. Liability & Property
Personal Valuables: NEST CoWork & Play GmbH is not liable for the loss, theft, or damage of personal property, including laptops, phones, or tablets. Members are responsible for their own equipment.
Transportation Liability: A designated area is provided for strollers and bikes in front of the building. NEST CoWork & Play accepts no liability for theft or damage to items left in this area.
Property Damage: Members are financially responsible for any significant damage to NEST CoWork & Play’s property, equipment, or furniture caused by intentional misuse or damage by their child.
Coworking Noise: The Coworking Area is adjacent to a childcare facility. A certain level of ambient "childhood noise" is expected and does not entitle members to refunds. Headphones are available for rent at the welcome desk for a fee.
3. Operational Policies
Punctuality: Children must be picked up and have exited the play area by the end of the scheduled time slot. Late pickups may result in additional fees or loss of booking privileges.
Force Majeure (Höhere Gewalt): In the event of unforeseen closures beyond the company's control (e.g., technical building failures, burst pipes, or official health-related closures/outbreaks), members are not automatically entitled to a refund or compensation.
Photo/Video Etiquette (GDPR/DSGVO): Filming or photographing other children or members is strictly prohibited. Social media posts are only permitted if no other identifiable persons are in the frame.
4. Behavioral Standards & Suspension of Service
General Conduct: The physical safety of all members and staff is our absolute priority. NEST CoWork & Play reserves the right to refuse service or terminate membership immediately if a member disrupts the environment or endangers others, regardless of "strike" counts.
Age-Appropriate Development (Under 30 Months): Behaviors like biting or hitting are recognized as potential developmental phases.
If a behavior occurs three (3) or more times in one session, the parent must intervene.
If it persists, NEST CoWork & Play reserves the right to dismiss the pair for the remainder of the day.
The Three-Strike Policy (Ages 2.5 and Older): Intentional aggression (hitting, biting, throwing objects) is subject to the following:
Strike 1: De-escalation and notification of parents; redirection strategy discussed.
Strike 2: Immediate notification. Parent must intervene. If behavior continues, the parent and child must vacate the Play Area (relocation to Café Area at management discretion).
Strike 3: NEST CoWork & Play reserves the right to implement a temporary suspension (e.g., 2 weeks) or terminate membership immediately without refund if safety remains at risk.
5. Cancellation & Pause Policy
Cancellation of Bookings:
Free Cancellation: Bookings may be cancelled free of charge up until 06:00 on the day of the reserved slot. Cancelled hours will be returned to the member's available contingent.
Late Cancellation: Cancellations received after 06:00 on the day of the booking will result in a deduction of 3 hours from the member's monthly contingent.
No-Show & Repeated Late Cancellations: Members who cancel late or fail to show up without notice 3 times in a row within a single month will receive a 3-day booking suspension.
Cancellation of the contract:
To end your subscription, you must cancel your contract with 30 days notice towards the end of the agreed upon subscription period, which is either 6 months or 12 months. Early termination does not free members up from paying for the remainder of their membership. When signing up for 12 months, the last month of the subscription is free.
Memberships/subscriptions can be paused for a maximum of 12 months and for a fee of 20€ per month. The fee is not charged if the pause happens for medical reasons such as pregnancy or long-term illness (requires an official doctors note stating that they can't work). After the pause, the contract continues for the remaining amount of months of that subscription.
5. EU Right of Withdrawal
In accordance with EU consumer protection laws, you have the right to withdraw from your membership contract within 14 days of purchase without providing any reason. To exercise this right, you must notify us in writing within the 14-day period. After the 14-day withdrawal period has expired, cancellation is only possible under the terms outlined in the Cancellation & Pause Policy.
NEST reserves the right to terminate memberships in cases of breach of contract, non-payment, or other violations of membership terms.
Data Protection & Privacy (GDPR)
We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
Data We Collect: When you sign up for a membership, we collect and process the following personal data: your name, date of birth and contact details, your child or children's names and date of birth, your child or children's measles vaccination status, payment information, photos/images (e.g. for your member profile), and location data where applicable.
Purpose & Legal Basis: Your data is collected solely for the purpose of managing your membership, processing payments, and providing our services. The legal basis for processing is the performance of a contract (Art. 6(1)(b) GDPR) and, where applicable, your consent (Art. 6(1)(a) GDPR).
Data Retention: We retain your personal data only for as long as necessary to fulfill the purposes outlined above, or as required by law.
Your Rights: You have the right to access, correct, or delete your personal data at any time. You also have the right to restrict or object to processing, as well as the right to data portability. To exercise your rights, please contact us at datenschutz@nestcoworkandplay.com.
Third Parties: We do not sell or share your personal data with third parties, except where required to process payments or comply with legal obligations.
If you have any concerns regarding the processing of your data, you have the right to lodge a complaint with the competent supervisory authority. In Germany, this is the data protection authority of the state in which our company is registered.
